Understanding Texas Dram Shop Laws

Under the Texas dram shop law found in the state's Alcoholic Beverage Code, anyone who serves or sells alcohol to a visibly intoxicated person who represents an obvious danger to himself or others can be held liable for injuries they cause later. This applies to bartenders, restaurants, private parties where liquor is being served, sporting events, and other venues. In each instance, proof must be provided indicating that an intoxicated person was served alcohol in a state where he or she was clearly a danger to themselves and others.
